Sumter County declares emergency

SUMTER COUNTY BOARD OF COMMISSIONERS

DECLARATION OF LOCAL EMERGENCY

WHEREAS, Sumter County, a political subdivision of the State of Georgia, has experienced an actual, threatened, or impending disaster or emergency that may result in the large-scale loss of life or injury, or property damage, destrnction, or a major disruption of routine community, business, or governmental affairs or operations in the County and which is of sufficient severity and magnitude to warrant assistance by federal, state, or local departments and agencies to supplement the efforts of available public and private resources;

WHEREAS, the nature of the disaster or emergency is potentially destructive weather, such as high winds and flooding, due to Hurricane Irma and related events (hereafter “Emergency”) which occurred on or about September 8, 2017; and

WHEREAS, the Governor of the State of Georgia has declared a state of emergency for Sumter County; and

WHEREAS, in the judgment of the Sumter County Board of Commissioners, upon advice of the Sumter County Emergency Management Agency, the Emergency requires extraordinary and immediate action for the protection of the public health, safety, and welfare of the citizens of Sumter County, including, but not limited to individuals with household pets and service animals; and

WHEREAS, to prevent or minimize injury to people and damage to property resulting from this Emergency, immediate action is required; and

WHEREAS, the Sumter County Board of Commissioners is authorized to declare a local state of emergency pursuant to the Georgia Emergency Management Act, the Sumter County Code of Ordinances, and other applicable laws.

IT IS HEREBY DECLARED that a local state of emergency exists and shall continue until the conditions requiring this declaration are abated and the Sumter County Board of Commissioners terminates the state of emergency by resolution.

BE IT FURTHER RESOLVED AND DECLARED that the Sumter Cmmty Emergency Management Agency shall immediately activate the Emergency Operations P1an;

BE IT FURTHER RESOLVED AND DECLARED that the following sections of the Sumter County Code of Ordinances shall be implemented and become effective immediately:

_X __ Sec. 30-38.-Authority to Waive Procedures and Fee Structures

_X __ Sec. 30-39.-Registration of Building and Repair Services

____ Sec. 30-40.-Closed or Restricted Areas and Curfews During Emergency

_X_ Sec 30-41. – Prohibition on overcharging for goods, materials, services, and housing during state of emergency

BE IT FURTHER RESOLVED AND DECLARED that the following measures shall also be implemented:

Any and all additional remedies or measures authorized pursuant to the Sumter County Code of Ordinances or the laws of the State of Georgia that are reasonably necessary to respond to this emergency.

BE IT FURTHER RESOLVED that all declarations, resolutions, or parts thereof in conflict herewith are hereby repealed and that this declaration shall become effective as of the date of its adoption.

BE IT FURTHER RESOLVED that a quorum of the Sumter County Board of Commissioners is unavailable despite reasonable efforts, and exigent circumstances require immediate action to avoid injury to person or property such that the Chair of the Board of Commissioners is authorized pursuant to Section 30-34 of the Sumter County Code of Ordinances to issue this Declaration of Local Emergency.
